TERMS & CONDITIONS OF PARTICIPATION

These Terms & Conditions ("Terms") govern attendance at and participation in any event, gathering, activity, program, trip, dinner, social event, networking event, recreational activity, volunteer opportunity, or other offering organized, hosted, sponsored, promoted, or facilitated by Kibbutz NYC ("Kibbutz NYC," "we," "us," or "our").

BY REGISTERING FOR, ATTENDING, OR PARTICIPATING IN ANY KIBBUTZ NYC EVENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS.

VOLUNTARY PARTICIPATION

Attendance and participation in Kibbutz NYC events are entirely voluntary. You understand and acknowledge that participation may involve known and unknown risks, including but not limited to personal injury, illness, allergic reactions, property damage, theft, emotional distress, transportation-related incidents, accidents, interactions with other attendees, and other risks that may arise before, during, or after an event.

You voluntarily assume all risks associated with your participation.

ASSUMPTION OF RISK

You expressly assume full responsibility for any and all risks, injuries, losses, damages, costs, or expenses arising from or related to your attendance at or participation in any Kibbutz NYC event, whether occurring on public or private property and whether caused by the actions of attendees, vendors, venue operators, third parties, or other participants.

You acknowledge that Kibbutz NYC cannot guarantee the safety, conduct, health status, actions, or behavior of any attendee or third party.

RELEASE OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE KIBBUTZ NYC, ITS FOUNDERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, VOLUNTEERS, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, LIABILITIES, COSTS, OR EXPENSES ARISING OUT OF OR RELATING TO YOUR ATTENDANCE AT OR PARTICIPATION IN ANY EVENT.

THIS RELEASE APPLIES TO PERSONAL INJURY, ILLNESS, PROPERTY DAMAGE, ECONOMIC LOSS, EMOTIONAL DISTRESS, AND OTHER LOSSES TO THE FULLEST EXTENT PERMITTED BY LAW.

NOTHING IN THESE TERMS SHALL LIMIT LIABILITY TO THE EXTENT SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.

FOOD AND BEVERAGE DISCLAIMER

Food and beverages may be provided by Kibbutz NYC, venues, caterers, volunteers, attendees, sponsors, or third parties.

YOU ACKNOWLEDGE AND AGREE THAT ANY CONSUMPTION OF FOOD OR BEVERAGES IS ENTIRELY AT YOUR OWN RISK.

Kibbutz NYC makes no representations, warranties, or guarantees regarding:

  • Food safety;

  • Preparation methods;

  • Sanitation practices;

  • Ingredient accuracy;

  • Cross-contamination prevention;

  • Allergen exposure;

  • Dietary compliance;

  • Nutritional information; or

  • Fitness for consumption.

Individuals with food allergies, sensitivities, dietary restrictions, or medical conditions are solely responsible for determining whether any food or beverage is suitable for consumption.

To the maximum extent permitted by law, Kibbutz NYC disclaims liability for any illness, allergic reaction, injury, or adverse consequence arising from the consumption of food or beverages at any event.

MEDICAL RESPONSIBILITY

Participants are solely responsible for their own medical care, medications, insurance coverage, and health-related decisions. Kibbutz NYC has no obligation to provide medical treatment, emergency services, or health supervision.

In the event of a medical emergency, Kibbutz NYC may, but is not obligated to, seek emergency assistance on a participant's behalf.

PERSONAL PROPERTY

Participants are solely responsible for safeguarding their personal belongings. Kibbutz NYC is not responsible for lost, stolen, misplaced, or damaged property.

ATTENDEE CONDUCT

Participants agree to behave respectfully and lawfully at all times.

Kibbutz NYC reserves the right to deny entry to, remove, suspend, or permanently prohibit any participant from attending future events for conduct deemed unsafe, disruptive, threatening, discriminatory, unlawful, or inconsistent with the purposes of the organization.

No refund shall be required following such removal.

SAFETY

Kibbutz NYC prioritizes the safety and well-being of attendees and may establish rules, procedures, screening requirements, capacity limits, or other safety measures at its sole discretion.

However, participants acknowledge that no safety program can eliminate all risks, and Kibbutz NYC does not guarantee the safety or security of any attendee.

PHOTOGRAPHY, VIDEO, MEDIA RELEASE, AND PUBLICITY RIGHTS

Kibbutz NYC and its representatives, photographers, videographers, media partners, sponsors, and authorized third parties may photograph, film, record, livestream, or otherwise capture attendees during any event.

By attending any Kibbutz NYC event, you irrevocably consent to and authorize the capture, recording, use, publication, reproduction, distribution, display, broadcast, modification, editing, creation of derivative works from, and other exploitation of your name, image, likeness, appearance, voice, statements, biographical information, and other identifying characteristics in any media format now known or later developed, throughout the world, in perpetuity, for any lawful purpose, including promotional, advertising, marketing, editorial, commercial, fundraising, educational, and social media purposes.

You acknowledge and agree that Kibbutz NYC shall be the sole and exclusive owner of all photographs, videos, recordings, livestreams, and other media captured at or relating to its events, including all intellectual property rights therein.

You waive any right to inspect, approve, review, edit, or receive compensation for the use of any such media.

To the maximum extent permitted by law, you release and discharge Kibbutz NYC from any and all claims arising out of or relating to the use of such media, including claims based on rights of privacy, rights of publicity, defamation, emotional distress, misappropriation, or similar causes of action.

If you do not wish to be photographed, filmed, or recorded, your sole remedy is to refrain from attending the event. Attendance constitutes your express agreement to this section.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Kibbutz NYC and its founders, officers, directors, volunteers, contractors, affiliates, and representatives from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising from:

(a) your participation in any event;
(b) your violation of these Terms; or
(c) your actions or omissions that cause harm to another person or property.

NO WARRANTIES

All events, activities, food, services, information, and materials are provided "AS IS" and "AS AVAILABLE."

Kibbutz NYC disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, safety, accuracy, or non-infringement.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.

SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between Kibbutz NYC and participants regarding attendance at and participation in Kibbutz NYC events and supersede any prior understandings or agreements relating to such participation.

BY ATTENDING, REGISTERING FOR, OR PARTICIPATING IN ANY KIBBUTZ NYC EVENT, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO THESE TERMS & CONDITIONS.
